Terms and Conditions (T&C) for Travel with Outdoor Education Spain S.L.

Outdoor Education Spain S.L. is the operating tour organizer for Camp Adventure camps in Spain and England. Full information about the offerings can be found on the website www.campadventure.de.

  1. Guarantees and Insurance

Outdoor Education Spain S.L. ensures that all participants are protected in accordance with Spanish legal regulations for tour operators. Under Article 167 of the Spanish General Law on the Protection of Consumers and Users (RDL 1/2007), customer payments are secured against insolvency through a bank guarantee. This guarantee is provided by La Caixa, and the bank's contact details will be included in the booking confirmation.

  1. Applicable Law and Consumer Protection

These Terms and Conditions comply with Spanish law, particularly the Law 21/1995 on Package Travel, as supplemented by EU Directive 2015/2302.

If the customer resides in another EU member state, the mandatory consumer protection laws of their country of residence will also apply in accordance with Article 6 of the Rome I Regulation.

  1. Formation of the Travel Contract

By registering for a trip, the customer submits a binding offer to conclude a travel contract with Outdoor Education Spain S.L.

  • Registration Methods: Registration can be made in writing, by telephone, by email, or via the online booking system "Book a Camp."
  • Confirmation: The contract is concluded once Outdoor Education Spain S.L. confirms the booking in text form (e.g., by email).
  • Travel Documents: Participants will receive all necessary travel documents no later than 7 days before the trip begins.

If essential changes to the contract are necessary, the customer will be informed in accordance with Article 159 of the Spanish General Law on Consumers and Users and will have the right to cancel the contract free of charge or choose an equivalent alternative.

Pre-Contractual Information: Outdoor Education Spain S.L. provides all mandatory pre-contractual information in accordance with Article 153 of the Spanish General Law on Consumers and Users and EU Directive 2015/2302, including detailed information about destinations, accommodations, meals, transfers, insolvency protection, emergency contacts during the trip, and any other legally required information.

  1. Payment Terms
  • Deposit: A deposit of €50 per participant is due within 7 days after the conclusion of the contract and receipt of the booking confirmation.
  • Final Payment: The remaining balance must be paid no later than 30 days before the start of the trip without additional request.
  • Insolvency Protection: Before accepting payment, a guarantee certificate will be issued to ensure the security of customer funds in accordance with Spanish law.
  • Non-Payment: If payment is not made, Outdoor Education Spain S.L. reserves the right to cancel the contract and charge cancellation fees as outlined below.
  1. Services and Service Modifications

The services are outlined in the service descriptions on the website www.campadventure.de and the booking confirmation.

  • Service Changes: Changes to significant services are only permitted if unavoidable, and Outdoor Education Spain S.L. will notify customers immediately in text form.
  • Unavoidable and Extraordinary Circumstances: Unavoidable and extraordinary circumstances include natural disasters, epidemics, pandemics, significant political unrest, or other events as defined in Article 12 of EU Directive 2015/2302, which are beyond the control of Outdoor Education Spain S.L. and significantly impede the fulfillment of the contract.

In such cases, customers have the right to cancel the contract free of charge or choose an equivalent alternative.

  1. Customer Cancellation

Customers may cancel the contract at any time before the trip begins. In such cases, Outdoor Education Spain S.L. may charge appropriate compensation, calculated as follows:

  • Up to 60 days before the trip: €100 flat fee per person
  • 59 to 31 days before the trip: 30% of the total price
  • 30 to 15 days before the trip: 50% of the total price
  • 14 to 1 day(s) before the trip: 80% of the total price
  • On the day of the trip or later: 90% of the total price

Group Bookings:

  • Adjustments of up to 10% in the number of participants are free of charge up to 30 days before the trip. Larger reductions or late cancellations will be individually assessed and based on the actual costs incurred.

Note: The cancellation fees reflect the expected costs incurred by Outdoor Education Spain S.L. and the loss of revenue due to the cancellation.

  1. Cancellation by Outdoor Education Spain S.L.

Outdoor Education Spain S.L. reserves the right to cancel the trip if the minimum number of participants is not reached.

  • The minimum number of participants and the cancellation deadline will be specified in the trip description and booking confirmation.
  • In the event of cancellation, customers will receive a full refund of all payments within 14 days.
  1. Liability and Warranty
  • Liability for Defects: Outdoor Education Spain S.L. is liable for the proper performance of the agreed services, except for third-party services that are clearly identified as such.
  • Limitation of Liability: Liability for damages that are not personal injuries is limited to three times the travel price, unless caused by gross negligence or intentional misconduct, or in cases where liability cannot be limited under applicable law. This limitation does not apply to personal injury, damages caused by gross negligence or intent, or any other cases where liability cannot be excluded under applicable law.
  • Defect Notification: Customers must report defects without undue delay, but no later than 7 days after discovering them. Failure to report a defect promptly does not affect the customer's right to claim compensation, provided the customer can demonstrate that the delay did not result in additional costs.
  1. Third-Party Services

Outdoor Education Spain S.L. is not liable for services provided by third parties that are clearly identified as such, and for which the name and contact details of the third-party provider are disclosed prior to the contract’s conclusion. Third-party services are explicitly identified in the travel documentation to ensure that customers can clearly recognize that these are not part of the package travel contract.

  1. Passport, Visa, and Health Requirements

Outdoor Education Spain S.L. will inform participants of the passport, visa, and health requirements applicable to their trip, including any changes or special requirements (e.g., Brexit-related rules for travel to England). Changes or special requirements will be communicated promptly.

  • Customer Responsibility: Customers are responsible for ensuring that they meet all requirements and bear the costs and consequences of non-compliance.
  1. Data Protection

Outdoor Education Spain S.L. collects and processes personal data in accordance with the EU General Data Protection Regulation (GDPR) and Spanish data protection law (Ley Orgánica 3/2018).

  • Customer Rights: Customers have the right to access, rectify, erase, and restrict the processing of their personal data. They also have the right to object to data processing and to data portability. If customers believe their data protection rights have been violated, they may file a complaint with the Spanish Data Protection Agency (Agencia Española de Protección de Datos - AEPD).
  1. Jurisdiction and Dispute Resolution
  • Jurisdiction: The place of jurisdiction for all disputes arising from this contract is Barcelona, Spain, unless mandatory consumer protection laws provide otherwise, such as the right to bring claims in the customer's country of residence.
  • Dispute Resolution: Outdoor Education Spain S.L. is willing to participate in voluntary dispute resolution procedures to resolve consumer disputes amicably. Customers are also referred to the EU online dispute resolution platform at http://ec.europa.eu/consumers/odr.
